This Terms of Use Agreement ("Agreement") governs your access to the Fostah Logistics Command Portal (the "Portal"). By logging in, you represent that you are an authorized User and agree to the following terms.

1. Authorized User Roles

Access to Portal modules is strictly restricted based on your assigned role. You agree not to attempt to bypass role-based security to access modules not intended for your level:

• Administrators: Full system control, user management, security monitoring, training oversight, document template management, and API configuration.
• Dispatchers: Live Fleet Maps, Load Assignments, and Driver communication tools.
• Drivers: Personal load manifests, Proof of Delivery (BOL) uploads, electronic document signing, mandatory training modules, and assigned vehicle DVR feeds.
• Customers: Real-time tracking of assigned freight and load status updates.

2. Use of Live Tracking & Surveillance

The Portal integrates real-time GPS and DVR data. Use of this data is subject to the following:

• Proprietary Data: Live maps and camera feeds are the trade secrets of Fostah Logistics LLC.
• No Distribution: You are strictly prohibited from recording, live-streaming, or sharing tracking links/video feeds with any person or entity outside of the Fostah Logistics ecosystem.
• Privacy: Surveillance data must be used strictly for safety, insurance, and operational efficiency purposes.

3. Electronic Signatures & Training Compliance

The Portal utilizes a secure electronic document signing and training system. By utilizing these features, you acknowledge and agree to the following:

• Binding Signatures: Any document signed electronically through the Portal holds the same legal weight and enforceability as a physical, handwritten signature.
• Audit Trails: To maintain legal compliance and prevent fraud, the Portal may log document names, messages, form-field values, signature/initial images, e-sign authorization hashes, timestamps, IP address, approximate IP location, device information, app/browser information, and viewing or download events.
• Training Records: Assigned courses, progress, quiz answers, acknowledgements, certificates, and completion timestamps may be retained for safety, compliance, and company recordkeeping.
• AI Field Detection: AI Auto Detect may process document pages to suggest signature, initial, date, checkbox, and text fields. Users and admins remain responsible for reviewing field placement and document accuracy.
• Integrity of Records: You agree not to spoof your location, mask security telemetry, manipulate device data, record restricted signing sessions, or tamper with training or signing records.

4. Zero-Tolerance Security Policy

Fostah Logistics LLC employs reCAPTCHA Enterprise and session-monitoring tools to protect our infrastructure. Login attempts and security events may be logged with username or email used, timestamps, IP address, approximate IP location, device ID, device model, operating system, app version, browser/user agent, root/jailbreak/emulator indicators, reCAPTCHA Enterprise scores, actions, and reason codes. Administrators may block users or devices, adjust reCAPTCHA score thresholds, require additional verification, and approve limited reCAPTCHA bypasses for specific accounts. We will pursue full civil and criminal penalties for any of the following:

• Credential Sharing: Lending your Portal login to any third party or former employee.
• System Probing: Using tools to scan, probe, or test the vulnerability of our Portal APIs, core systems, or MySQL databases.
• Data Scraping: Using automated bots or "crawlers" to extract driver logs or customer information.
• Identity Spoofing: Manipulating headers or session tokens to impersonate another user or administrator.

5. Account Responsibility & Passwords

You are the sole custodian of your Portal account. You agree to use a complex password that meets our system requirements. Fostah Logistics LLC is not liable for data breaches resulting from weak user passwords or compromised local devices. You agree to immediately report any suspected unauthorized access to mike@fostahlogistics.com.

6. Professional Conduct & Privilege

Access to this Portal is a professional privilege. Abuse of the system, including the entry of false load data, harassment via dispatch modules, or unauthorized modification of system settings, will result in the immediate and permanent revocation of your license to use the Portal.

7. Right to Be Forgotten (Data Deletion)

In accordance with our Privacy Policy, you may request the deletion of your account and personal identifiers. Please note that operational data, including BOLs, GPS history, load logs, trip sheets, payroll records, signed document audit trails, training records, security logs, failed login history, and admin verification logs, may be maintained for legal, tax, safety, insurance, fraud-prevention, and compliance purposes and may be anonymized but not fully deleted.

8. Limitation of Liability

Fostah Logistics LLC provides this Portal "as is" and makes no guarantees regarding 100% uptime. We are not responsible for business losses, missed loads, or logistical errors caused by internet outages, server maintenance, or third-party API failures (Google Maps, HostGator).

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law principles. You agree that any legal action arising from your use of the Portal shall be filed exclusively in the courts located within Arizona.
